French arbitration law is based on a dual system of control of arbitral awards. Following several decisions issued by both judicial and administrative Courts, as well as the Court established to settle conflicts of jurisdiction (the “Tribunal des conflits”), such as the Inserm, the Fosmax or the Ryanair (SMAC) cases, this duality is henceforth asserted. Pursuant to French law, administrative Courts implement an in-depth control regarding international arbitral awards dealing with the major proportion of administrative contracts entered into by and among French public persons and foreign entities. Should this duality become manifest, nevertheless, its precise scope remain unclear. The present contribution consists in mapping the dual monitoring system in order to shed some light over the still existing grey areas.
