This
paper summarises the discussion that took place on 5 June 2015 in Geneva during
a workshop organised by Francarbi on the aspects relating to the use of
languages in international arbitration. The discussion included the perspective
of all the participants in an arbitration, the contracting parties’ views,
counsel’s perspectives and the arbitrators’ approach. The discussion and the
present account follow the time line in which issues are bound to arise, from
the negotiation and drafting of the contract until the post-award stages,
including setting aside proceedings and the enforcement of an award abroad.
