Article 11 of the Law of 18 November 2016, stated to be a “modernization of Justice in the 21st century”, modified article 2061 of the Civil Code relating to arbitration clauses. The terms of the modified article will require interpretation. Whilst the scope of an arbitration clause’s effect may have been extended, the legal regime applicable thereto may have become less precise. This article aims to remove ambiguity from the revised article 2061. The Law also introduced a few semantic alterations which affect other aspects of arbitral vocabulary, but these do not pose any problem.
