In the event of a breach of contract, the Administrative Order of 10 February 2016 recognises as a matter of principle that the beneficiary of a contractual obligation is entitled to specific performance, either from the party in breach (article 1221 Civil Code), or from a third party (article 1222 Civil Code).The privileged status granted to specific performance amongst the various remedies for breach goes hand in hand with the growth, which is hesitant but real, of this remedy in international arbitration. This review then examines the legal and contractual limits which apply to enforced execution, in order to determine the true scope of this principle.
