The aim of the article is to identify those criminal offences which an arbitrator must take into account and which necessarily influence the outcome of the dispute. All offences are not necessarily concerned. Only serious offences have such an effect, as opposed to preventive and instrumental offences. However there is no condition to restrict such an effect; thus the bad faith of the party relying upon criminal illegality is of no consequence.
