At the annual session of the Council of Ministers of the OHADA, held on 23 and 24 November 2017 in Conakry (Guinea), the ministers of the member States of this regional organization adopted a new uniform Act on arbitration, replacing that of 11 March 1999. They also revised the Arbitration Rules of the Common Court of Justice and Arbitration (CCJA). The two newly adopted instruments now integrate investment arbitration. Despite its symbolic significance, at a time when investment arbitration is experiencing a “soft death” in Europe and other parts of the world, this integration raises many questions both in the context of the new uniform Act and the modified CCJA arbitration Rules.
