Fusionner les régimes de l’arbitrage interne et international, à rebours de son histoire et de la représentation sur laquelle il est structuré, pourrait lui porter un coup très dur. L’arbitrage international doit conserver son autonomie et l’arbitrage interne ses spécificités, ce d’autant qu’aucune considération solide ne justifie un régime unique.
The dualism of French arbitration law is the driving force behind its attractiveness. Merging the regimes governing domestic and international arbitration, contrary to its historical development and the conceptual framework upon which it is built, could therefore deal it a very serious blow. International arbitration must retain its autonomy, and domestic arbitration its specific features, all the more so as no compelling justification supports the adoption of a single, unified, regime.
