Summary

 

The French Cour de cassation, after a decision that was hostile to the arbitration clause in 1843, has on the contrary adopted, since 1963, case-law that are favorable to international arbitration, on the basis of the recognition of on arbitral legal order distinct from the national legal orders. The article examines the milestones decisions of the Cour de cassation and its policy towards arbitration. Recently, French law on arbitration witnessed a first set-back, due to a decision of the Tribunal des conflits, not the Cour de cassation.
