Summary
OHADA (Organization for the Harmonization in Africa of Business Law) is a system of business laws uniform across 17 West and Central African countries. The purpose of this system is to make these countries more attractive to foreign investors.
Currently, parties seeking to arbitrate under OHADA have the choice between ad hoc arbitration under the Uniform Act on Arbitration and institutional arbitration according to the Arbitration Rules of the Common Court of Justice and Arbitration (“CCJA”), the leading arbitral institution. This contribution offers a clear overview of OHADA’s arbitration system and demonstrate that the predictability of OHADA contribute to a better business climate in Africa.
