Summary
The application for setting aside of the award must be initiated within a delay of three months after the date the applicant received the arbitral award. The starting point of this delay is to be determined in accordance with Article 1678 B.J.C., which paragraph 2 determines exactly when the starting point occurs, depending on the mode of communication. When the award has been communicated to the applicant by registered mail, the starting point of the delay is the third day after the datethe mail has been presented to the postal office, irrespective of the fact whether the addressee came to fetch that mail or not.
