Summary
1°- The particular transitional rules provided by the Belgian Law on Arbitration (Act of 24 June 2013) do not apply to the provisions of the Belgian Law on Arbitration where, failing a request for arbitration, the parties litigate before the state courts the validity of the arbitration agreement. Concerning agreements, the old law remains applicable, save where the new law is of public policy or a mandatory law, or provides for its immediate application.
