ABSTRACT: This article is the written version of the Opening Lecture given at the First Arbitration Masterclass held in Brazil and sponsored by the ICC International Business Institute. At this conference, were briefly examined the fundamental differences of performance between the arbitrator and the state judge, which influence the qualities that are required from the arbitrator, both from the point of view of their ethical standards (being, acting and gain the confidence of the parties, their representatives and other arbitrators), as their efficiency standards. The role of an arbitrator must always be based on respect for the will of the parties, respect of the due process of law, the issue of an award with quality, valid and enforceable, within a reasonable time, able to render a satisfactory solution to the dispute, at a moderate cost to the parties.
